RecordeXe Terms of Use

These Terms of Use (the "Terms") are an agreement between you and devride.com ("devride.com", "we", "us") for your use of RecordeXe, our screen recording and video editing app for Windows, together with its account service and any updates (the "App").

By installing, signing in to or using the App, you agree to these Terms. If you do not agree, do not use the App. If you use the App on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

Where you obtained the App from the Microsoft Store, the Microsoft Store terms of sale and Microsoft's Standard Application License Terms also apply. If they conflict with these Terms on a matter between you and devride.com, these Terms prevail to the extent the Store terms allow.

1. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Windows devices you own or control, as permitted by the Microsoft Store.

You may not, and may not help anyone else to:

copy, modify, or create derivative works of the App, except as the law expressly allows;
reverse engineer, decompile or disassemble the App, except to the extent the law permits despite this restriction;
remove or bypass watermarks, recording limits, licence or subscription checks, or other technical restrictions;
rent, lease, sell, sublicense or redistribute the App;
remove copyright, trademark or other notices.

The App is licensed, not sold. We and our licensors keep all rights not expressly granted.

2. Your account

You need an account to use the App. Provide a valid email address that you control; registrations from disposable email services are not accepted.
Keep your password confidential. You are responsible for activity under your account. Tell us promptly at alisufyanbutt@hotmail.com if you think your account has been compromised.
You must be at least 13 years old, or the minimum age required in your country, to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
How we handle your account data is described in the RecordeXe Privacy Policy at https://devride.com/products/recordexe/privacy.

3. Acceptable use and recording laws

RecordeXe can capture your screen, system sound, microphone and webcam. You are solely responsible for what you record and how you use your recordings. In particular, you agree that you will:

obtain any consent required before recording other people, for example participants in a video call, meeting, class or voice chat, and comply with all laws on recording conversations, including laws that require the consent of every party;
respect copyright and other rights in content you capture, such as films, streaming services, music, software, games and courses, and not use the App to infringe or to circumvent copy protection (DRM);
comply with privacy and data protection laws when recordings contain personal data about others, and with any rules set by your employer, school or the services you record;
not use the App to record anyone secretly, to harass, stalk or exploit anyone, or to create or distribute unlawful content;
not interfere with, overload, probe or attempt unauthorised access to the account service, and not create accounts by automated means.

We do not monitor your recordings, which stay on your PC, and we are not responsible for how you use them.

4. Plans, trial and subscriptions

4.1 Free trial

New accounts get a 7-day free trial with every feature unlocked. During the trial, recordings are capped at 10 minutes and include a small watermark. The trial is available once per account and cannot be restarted by reinstalling the App or changing device settings.

4.2 Free plan

After the trial, you can keep using the App on the Free plan at no charge. On the Free plan:

recordings are capped at 5 minutes, at up to 1080p and 30 fps, and include a watermark;
trimming and timeline cuts (split, delete parts, undo and redo, playback speed), H.264 MP4 export at Balanced quality, GIF export, MP3, M4A and WAV audio export, the library, scheduled recordings, global shortcuts, Print Screen screenshots (copy and save) and placing the webcam before recording are included;
Pro tools are not included: looks, colour grading and LUTs, auto-zoom, keystroke overlay, cursor effects, Instant Replay, voice cleanup, export quality presets, HEVC export, fitting an export under a file size, moving, resizing or hiding the webcam after recording, screenshot annotation, and 4K, 60 fps and 120 fps recording.

We may change what the Free plan includes, with notice as described in section 12.

4.3 RecordeXe Pro

RecordeXe Pro removes the recording length cap and the watermark and unlocks all features, including the Pro tools listed in section 4.2. It is offered as an auto-renewing subscription through the Microsoft Store at US$2.99 per month or US$19.99 per year. Prices in other countries and currencies are set by the Microsoft Store, the App shows the price the Microsoft Store provides in your currency, and taxes may apply.

Billing. All purchases are processed by Microsoft. Your subscription renews automatically at the end of each billing period and Microsoft charges your payment method unless you cancel before renewal. We do not receive or store your payment details.
Cancellation. Cancel at any time from your Microsoft account (account.microsoft.com > Services & subscriptions). Pro stays active until the end of the current billing period, after which your account returns to the Free plan.
Refunds. Refunds are handled by Microsoft under the Microsoft Store refund policy and applicable consumer law. Nothing in these Terms limits any statutory right you have, such as a right of withdrawal.
Restoring purchases. Use the restore option in the App to reactivate Pro on the same Microsoft account, for example after reinstalling or on another PC.
Price changes. We may change subscription prices. Microsoft will notify you in advance as required, and the new price applies from your next renewal. If you do not agree, cancel before it takes effect.

If the App cannot reach the Microsoft Store to confirm your subscription, some Pro features may be temporarily unavailable until the check succeeds.

5. Your content

You own your recordings. Recordings, screenshots, edits and exports you create with the App ("Your Content") belong to you (or to whoever owns the underlying material). We claim no ownership of Your Content and receive no licence to it.
Your Content is stored on your PC and is not uploaded by the App. You are responsible for backing it up. Uninstalling the App or deleting files may make Your Content unrecoverable.
Watermarks added on the trial or Free plan are part of the output for those plans; you may not remove them by technical means.
The looks included with the App are licensed to you for use in Your Content, including commercial use. LUT files you import remain subject to their own licences.

6. Third-party components and services

The App includes third-party and open-source software components, each licensed under its own terms. Where required, those terms are provided with the App or are available on request, and they govern your use of those components to the extent they conflict with these Terms.
The App relies on services provided by third parties, including Microsoft Azure (hosting of our account service), Azure Communication Services (account emails) and the Microsoft Store (payments and subscriptions). The optional Studio voice model is downloaded from GitHub. Their availability is not fully within our control.
Video encoding features such as H.265 recording and HEVC (H.265) export depend on the codecs and graphics hardware available on your device. If your PC has no HEVC encoder, HEVC export is not available.

7. Updates and changes to the App

We may update the App to fix problems, improve it, or add, change or remove features. Some updates may be required to keep using the App or the account service. We will not remove a paid feature from an active Pro subscription period without offering a fair remedy where the law requires.

8. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the App will be uninterrupted, error-free or compatible with every device. We do not guarantee that every recording will succeed or that files cannot be lost, for example because of hardware faults, insufficient disk space, driver issues or system crashes.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. If you are a consumer, you keep any rights the law gives you that cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law:

devride.com will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, recordings, profits, revenue, goodwill or business opportunity, arising out of or relating to the App or these Terms, even if advised of the possibility;
devride.com's total liability for all claims relating to the App or these Terms is limited to the greater of (a) the amount you paid for RecordeXe Pro in the 12 months before the event giving rise to the claim, or (b) US$10.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, fraud, or wilful misconduct.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold devride.com harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content or your breach of these Terms or of any law, including recording, privacy and copyright laws.

11. Suspension and termination

You may stop using the App at any time by uninstalling it, and ask us to delete your account by emailing alisufyanbutt@hotmail.com. Cancel any Microsoft Store subscription separately.
We may suspend or terminate your account or access to the App if you materially breach these Terms, if required by law, or to protect the service or other users. Where reasonable, we will tell you first and give you a chance to fix the issue.
We may discontinue the App or the account service with reasonable advance notice. If we do, we will work with the Microsoft Store to handle any prepaid subscription period fairly.
On termination your licence ends. Sections 3, 5, 8, 9, 10, 13 and 14 continue to apply. Your recordings remain on your PC and remain yours.

12. Changes to these Terms

We may update these Terms from time to time. We will change the effective date above and, for material changes, give notice in the App, on the Store listing or by email before they take effect. If you keep using the App after the changes take effect, you accept the updated Terms. If you do not agree, stop using the App and cancel any subscription.

13. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law rules. The courts of the Islamic Republic of Pakistan have jurisdiction over any dispute arising out of or relating to these Terms or the App, unless the law of the country where you live as a consumer gives you the right to bring proceedings in your local courts or to rely on mandatory local consumer protections, in which case those rights are not affected.

14. General

These Terms, together with the Privacy Policy and the applicable Microsoft Store terms, are the entire agreement between you and us about the App.
If any provision is found unenforceable, the rest remains in effect.
Our failure to enforce a provision is not a waiver.
You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets.
Microsoft is not a party to these Terms and is not responsible for the App or its support.
