CutePets, Terms of Use / End User Licence Agreement

1. Agreement
By installing or using CutePets ("the App") you agree to these Terms. If you do not agree, do not install or use the App. These Terms sit alongside the Microsoft Store Terms of Sale and the Microsoft Services Agreement, which govern your purchase, your refunds and your Microsoft account. Where the Microsoft terms and these Terms conflict on matters of purchase and refund, the Microsoft terms prevail.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices associated with your Microsoft account, in accordance with the Microsoft Store Terms of Sale, for your own non-commercial enjoyment.
3. What you may not do
You may not, except where the law expressly permits it despite this clause:
- reverse engineer, decompile or disassemble the App;
- rent, lease, lend, sell, redistribute or sublicense the App;
- circumvent, disable or tamper with app protections;
- remove or obscure any copyright, trade mark or attribution notice;
- use the App's assets, artwork, models, sounds, text or code, in another product.
4. Price and included content
The App is sold for a one-off Store price. Version 1 includes six companions: cat, dog, rabbit, alpaca, cow and wolf.
5. Refunds
Refunds are handled by Microsoft under the Microsoft Store Terms of Sale. We cannot issue refunds ourselves.
6. Your save data
Your pets live in a file on your own computer. We have no copy of it and cannot restore it for you. Back it up yourself if it matters to you, see the Privacy Policy for the location. Uninstalling the App leaves the save in place; the App's own "Start over" command deletes your pets permanently and cannot be undone.
7. In-game loss
CutePets simulates a life cycle. Pets age in real time and eventually pass away peacefully; neglect can shorten that life. This is an intended part of the experience and is not a defect.
8. Third-party components
The App includes third-party open-source software and CC0 (public domain
dedication) 3D models. Their licences and attributions are listed in
ATTRIBUTION.md, distributed with the App, and those licences continue to govern
those components. Nothing in these Terms restricts your rights under an
applicable open-source licence.
9. No warranty
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of data, profits or goodwill, arising from your use of the App. Our total aggregate liability is limited to the amount you actually paid for the App.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you have statutory rights that these Terms do not affect.
11. Updates
We may release updates through the Microsoft Store. Updates may add, change or remove features. These Terms apply to updates unless an update ships with its own terms.
12. Termination
This licence ends if you breach these Terms or uninstall the App. Sections 3, 6, 9, 10 survive termination.
