1. Acceptance of these terms

These Terms and Conditions ("Terms") are an agreement between you and Technocrux ("we", "us") covering your use of the MindMapX application ("the App").

By installing, signing in to, or using the App you agree to these Terms. If you do not agree, do not use the App.

Your use of the App is also subject to the Microsoft Store Terms of Sale and Microsoft's own terms, because the App is distributed and billed through the Microsoft Store.

Our handling of personal information is described in the MindMapX Privacy Policy, which forms part of these Terms.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you control, for as long as you comply with these Terms and hold a valid trial or subscription.

You may not:

Copy, sell, rent, lease, sublicense or redistribute the App.
Reverse engineer, decompile or disassemble the App, except where that right cannot be excluded by law.
Remove or alter any notices in the App.
Circumvent, disable or tamper with the trial period, the subscription check, the authentication system, or any licensing mechanism.
Use the App in a way that breaches these Terms or applicable law.

We retain all rights in the App itself, including its code, design, name and branding. Nothing here transfers ownership of the App to you.

3. Your account

To use the App you need an account.

You must provide an accurate name and a working email address, and you must be able to receive email at that address (verification and password-reset codes are sent there).
You are responsible for keeping your password confidential and for everything done through your account.
We recommend enabling the optional two-factor authentication. If you do, keep your recovery codes somewhere safe, if you lose both your authenticator and your recovery codes, we may not be able to restore access.
Tell us promptly at hello@devride.com if you believe your account has been used without your permission.
One account is for one person. Do not share your account credentials.
You must be old enough to enter into a contract in your country, and at least 13 years old.

You can ask us to delete your account by emailing hello@devride.com from the account's email address.

4. Internet connection

The App requires an internet connection to sign in. It also needs one to verify your email address, reset a password, check your subscription status with the Microsoft Store, and download icon stickers.

Creating and editing mind maps happens on your own PC.

5. Your content, and backing it up

You own your content. Every mind map you create, topic text, notes, tasks, markers, attached images and recorded voice notes, belongs to you. Technocrux claims no ownership of it and no licence over it.

Your maps are stored only on your PC, as .mflow / .mindflow files under %LOCALAPPDATA%\MindMapX\Maps, along with an AutoSave folder. The App has no cloud sync, no sharing and no collaboration. We never receive your maps, and we cannot read, recover or restore them.

Backing up your maps is your responsibility. If your PC fails, is reset, or the files are deleted or corrupted, your maps are gone and we cannot help you recover them. Keep your own backups of %LOCALAPPDATA%\MindMapX\Maps.

You are responsible for the content you create and for having the rights to any images or audio you attach.

6. Acceptable use

You agree not to use the App:

For anything unlawful, or to create or store material that is unlawful.
To infringe anyone else's intellectual property or privacy rights.
To attempt to gain unauthorised access to our systems or another user's account.
To interfere with, overload or disrupt our authentication service or any third-party service the App relies on.
To automate or script the App in ways that abuse the free trial or the subscription system.

7. Free trial, subscriptions and billing

7.1 Free trial

MindMapX includes a 7-day free trial. No payment card is required to start it.

The date your trial started is recorded both on your device and on your account, so that the trial cannot be restarted by reinstalling the App or changing your PC's clock. One trial applies per account.

7.2 Subscription prices

After the trial, a subscription is required to continue using the App:

Prices are shown in US dollars. The actual amount charged, currency and any taxes are determined by the Microsoft Store for your market. Prices may change; a change will not affect a period you have already paid for.

7.3 Billing

All payments are processed by Microsoft through the Microsoft Store. Technocrux does not see, handle or store your payment card details. Subscriptions renew automatically according to Microsoft Store terms until cancelled.

7.4 Cancellation

You manage and cancel your subscription through your Microsoft account, not through the App and not through us. Cancelling stops future renewals; you keep access until the end of the period you have paid for.

7.5 Refunds

Refunds are handled by Microsoft and are governed by Microsoft Store refund policy. Technocrux cannot issue refunds for purchases made through the Microsoft Store. Please direct refund requests to Microsoft.

7.6 When the trial or subscription lapses

When your free trial ends, or a subscription lapses or is cancelled, the App requires a subscription in order to continue. Your map files remain on your PC and are not deleted by us, they are ordinary files in your own storage and remain under your control.

8. Third-party services

The App relies on services we do not control:

Microsoft Store, distribution, payments and subscription status.
jsDelivr CDN (cdn.jsdelivr.net), icon stickers are downloaded from this public CDN when you use them.

These services have their own terms and privacy practices. We are not responsible for their availability, performance or conduct. If one of them is unavailable, the related feature of the App may not work.

9. Availability and changes to the App

We may update, change or discontinue features of the App. We aim to keep the authentication service available, but we do not promise uninterrupted or error-free operation. Maintenance, outages, network problems or changes by Microsoft may interrupt service.

If we discontinue the App entirely, we will make a reasonable effort to give notice. Your existing map files will remain on your PC as ordinary files.

10. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will meet your requirements, that it will be uninterrupted or error-free, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties. If you are a consumer, you may have statutory rights that these Terms do not and cannot limit. Nothing in these Terms affects those rights.

11. Limitation of liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, consequential or punitive damages.
We are not liable for loss of, or damage to, your data or mind maps. Your maps are stored only on your PC and backing them up is your responsibility (see section 5).
Our total liability to you for any claim relating to the App is limited to the amount you paid us or through the Microsoft Store for the App in the 12 months before the claim arose.

Nothing in this section excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

12. Termination

By you. You may stop using the App at any time, cancel your subscription through your Microsoft account, and ask us to delete your account.

By us. We may suspend or terminate your account if you materially breach these Terms, for example by attempting to circumvent the trial or subscription system, by using the App unlawfully, or by attacking our services. Where it is reasonable to do so, we will tell you why.

On termination your licence to use the App ends. Your map files remain on your PC and remain yours.

Sections 5, 10, 11, 13 and 14 survive termination.

13. Changes to these Terms

We may update these Terms. When we do, we will change the effective date at the top and publish the updated Terms at the same location. If a change is material, we will make a reasonable effort to notify you in the App or by email. Continuing to use the App after an update means you accept the updated Terms. If you do not accept them, stop using the App and cancel your subscription.

14. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of the Islamic Republic of Pakistan have jurisdiction over any dispute, without regard to conflict-of-laws rules.

If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your country of residence.

15. General

Severability. If any provision is found unenforceable, the rest remains in force.
No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Technocrux about the App, alongside the Microsoft Store terms that govern your purchase.
